Privacy Policy

Privacy Policy

gloops Inc. and its affiliates (hereinafter collectively referred to as the “Company”) will handle the information collected from users (hereinafter referred to as “End-Users” or “you”) utilizing the Company’s mobile social applications, websites, and services (hereinafter collectively referred to as “Services”) as follows (such information hereinafter referred to as “User Information”) and shall comply with this Privacy Policy (hereinafter referred to as “Privacy Policy”).

The Company feels a very important obligation in protecting user information. Besides complying with the applicable law and the Privacy Policy, the Company is continuously working hard on improving its protective measures.

While making use of the Company’s Services, End-Users are subject to use social network services (referred to as “SNS” below), links, advertisements, and other services not managed by the Company (referred to as “Third Party Services” below). Each of the Third Party Services has its own privacy policy. When using a Third Party Service, the service provider’s privacy policy of each Third Party Service (hereinafter referred to as “Third Party Service Provider”) also applies. The Company highly recommends that you understand the Third Party Service Provider’s terms of use and privacy policy when using Third Party Services through the Company’s Services. The Company is not at all responsible with respect to any Third Party Service Provider’s privacy policy and/or any such provider’s policies and actions regarding data protection.

Collection of User Information

End-Users agree to the Company collecting the following personal information (which is authorized under applicable law; such information hereinafter referred to as “Personal Information”) and information other than Personal Information (hereinafter referred to as “Non-Personal Information”).

(1) Information related to End-Users

When an End-User registers with one of the Company’s Services, etc., the Company may directly collect the End-User’s name, email address, username, nickname, password along with username and related information, etc. used in a Third Party Service.
When an End-User contacts the Company’s support through email or telephone regarding one of the Company’s Services for an inquiry or such other purpose, the Company may collect information such as email addresses, phone numbers, and the contents of such inquiry.

(2) Contact Information

The Company may provide functions, through its Services, to look up your location using your contact information, send invitations and offer game play. There may be a possibility that the Company collects address book information and SNS friends lists at the same time. The Company shall obtain your prior consent when the Company intends to collect your address book information and SNS friends list.

(3) Information on communication devices

The Company may collect certain information about the communication devices (smartphone, tablet, cellphone, etc.) used to connect to the Company’s Services, such as the unique ID of the device, IP address, the name given to the device by the End-User, the type of device (including its model number), and the country where network connection is being made, etc.

(4) Operating environment and usage history

The Company may collect information about the operating environment and usage history (including, but not limited to, the browser being used, browser language, website viewing history, the platform being used, exchanges with other End-Users, and the state of operation of the Company’s Services). The Company may also obtain information through log files and cookies. Please read the following section (2 Methods of Collecting Personal Information) for details.

Methods of Collecting Personal Information

The Company may collect user information in the following ways:

(1) Provided directly from the End-User

As mentioned above, the Company collects information about you directly from you when you register with the Company or if you send an email to the Company through its website or contact the Company by phone.

(2) When communicated or shared with other End-Users

You may also participate in certain activities on the Company’s Services that give you the opportunity to voluntarily communicate or share information with other Company End-Users, such as posting messages on a message board, posting public comments to user profiles or games, sending private messages, sending invitations, and posting photos, etc., which the Company may collect pursuant to this Privacy Policy.
To the extent permitted by law or regulation, the Company may monitor, record, and store these communications in order to protect your well-being and safety or to protect and defend the Company’s rights and property. By using the Company’s Services, you consent to the monitoring, recording and storage of such communications for these purposes.

(3) Through log files and cookies

When you use one of the Company’s Services, the Company may collect information about how you use and interact with that Service. Such information will be collected and stored through the use of log files and cookies. When you use one of the Company’s Services, the Company may place movement directives in the End-User’s mobile device by way of a cookie or in such other way. Information collected through cookies is stored on the End-User’s hardware as movement directives and not stored inside of the Company’s Services. Cookies are used for End-Users’ convenience in using the Services. The Company collects such information in order to simplify the authorization process and to improve and personalize the Services the Company provides to you (where such personalization includes, but is not limited to, the provision of information relevant to your usage).

How the Company Uses User Information the Company Collects

The Company may use the User Information the Company collects for the following purposes:

  • (1) To create your account for the Company’s Services;
  • (2) To provide you with a customized or personalized experience;
  • (3) To identify End-Users and suggest connections with other Company’s users or to send invites on your behalf to your social networking friends or contacts in your address book;
  • (4) As required by law or regulation, for example (but not limited to the following), to enforce the Company’s Terms of Use or to prevent fraud or other illegal activities;
  • (5) To provide End-Users with relevant and targeted advertising for the Company or a third party;
  • (6) To send you emails with useful information or promotions about the Company’s Services and other products and services;
  • (7) To send you notifications (SMS, push, remote, or local, etc.) to your mobile device to provide you with useful information about the Company’s Services and other products and services; or
  • (8) To respond to your questions or comments.

The Company does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to use the Company’s Services without verification from a parent or legal guardian. If you are under 13, please do not send any information about yourself to the Company, including your name, address, telephone number, or email address. In the event that the Company discovers that it has collected personal information from a child under the age of 13 without verification from a parent or legal guardian, the Company will delete such information as quickly as possible in a secure manner. Upon request, parents or legal guardians who have provided verification may review any such personal information the Company has on record and may opt to have such information deleted. If you believe that the Company might have any information from or about a child under the age of 13, please contact the Company at help@gloops.com.

Provision of Information with Third Parties

Except as otherwise stated below, the Company does not provide End-Users’ Personal Information to third parties. Information whereby an End-User cannot otherwise be identified may be provided to a third party, for example, in order to investigate End-User activity, to improve the Company’s services, or to provide advertisements through the Company’s Services. While the Company does not provide Personal Information to third parties with the intent to let them advertise their services and products or those of others, the Company may use third party advertisers to deliver advertising within the Company mobile environment, and for such purpose the Company may provide information, such as your operating system, the country where the Company’s Services are used and information whereby an End-User cannot otherwise be identified about usage of the Company’s Services, to these third party advertisers for the purposes of delivering these advertisements.

If you refuse to allow the provision of Personal Information to a third party, you should not provide your Personal Information to the Company when using the Company’s Services. When providing Personal Information to the Company, the Company assumes that you agree to the following matters.

Regardless of the foregoing, if the Company subcontracts all or part of its operation to a subcontractor, the Company may provide Personal Information to such subcontractor. In that event, the Company takes necessary and appropriate precautions to ensure that such user information will be managed in a secure manner.

(1) Provision to a Third Party Service Provider

The Company may use Third Party Service Providers, such as payment settlement companies, distribution companies, and analytics companies, to help the Company provide or improve the services the Company offers you. The Company may provide your Personal Information to these Third Party Service Providers so that they may provide their services to the Company.

(2) Provision to Users of a Social Network Service

Your profile, which includes your username, profile picture, etc., may be visible to other third party social network users. In addition, your social networking friends may be able to see information about your uses and the contents of your comments in the Company’s Services, for example your game results, scores, and profile information which may be posted on your Facebook page or Twitter.

(3) Provision to other End-Users

Your Personal Information (including, but not limited to, your profile and nickname) may also be visible to other Company End Users through the Services and related websites. Other End Users (whether SNS users or not) may be able to view information about your uses and comments, such as your game results, scores, and profile information.

(4) Provision as Required by Law

The Company may provide your Personal Information to third parties as required by law or regulation or to cooperate with regulators or law enforcement authorities. The Company may also provide your information to third parties in order to protect the rights or property of a third party or the Company (including, but not limited to, the rights under the Terms of Use and the property in respect of the Services).

(5) Provision for Health and Safety Reasons

If the Company determines that End-Users’ health or safety is threatened and requires an urgent measure, End-Users’ Personal Information may be disclosed to third parties or generally.

(6) Provision as a Result of Business Transfer

If the primary business of the Company is transferred through a merger, acquisition by another company, or sale of its assets (hereinafter referred to as “Business Transfer”), the Company may transfer your personal information to the transferee in such transfer. If material changes to the Company’s privacy practices occur as a result of the Business Transfer, the Company will revise this Privacy Policy, and any Personal Information acquired prior to such revision shall be handled under the then-current  Privacy Policy unless any End-User ceases to use the Services (the End-User will be deemed to have accepted the revised Privacy Policy by continuously using the Services).

Information Security Measures

The Company implements appropriate structural, personnel, physical, and technological security measures and maintain reasonable information security measures to protect user information. (For example, the Company protects user information by using methods including, but not limited to, firewalls, and Secure Socket Layer (SSL) encryption.) However, the Company does not make any representation that the method to be implemented by the Company will be the best possible measure.

While the Company takes reasonable precautions against possible security threats, there is no guarantee that such measures will be perfect. Accordingly, the Company cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur.

The Company strongly recommends that you take steps to maximize the security of your information (for instance, you may do so by not sharing your login information and by logging out of your account after you are done using the Company’s Services).

The Company stores user information in Japan, but you consent that such user information may be transferred to another country.

The Company requires that all reasonable information security measures to protect the Personal Information mentioned in the Privacy Policy are being conducted by third parties to whom Personal Information is provided under this Policy.

FOR RESIDENTS OF CALIFORNIA

Residents of California may request: a) a list of certain categories of personal information that the Company discloses to third parties for those third parties’ direct marketing purposes; and b) a list of the names and addresses of all of the third parties that received personal information from the Company for the third parties' direct marketing purposes during the preceding calendar year. Changes to the Company’s Privacy Policy

From time to time, the Company may make changes to this Privacy Policy. If the Company makes a change to this Privacy Policy, the Company will notify you and other End-Users by posting a notice. Any changes to this Privacy Policy will take effect, which is to be indicated at the end of this Privacy Policy. End-Users will be deemed to have accepted the revised Privacy Policy by continuously using the Services after the revision of the Privacy Policy.

How to Contact the Company

The Company allows users to change their user information. Through the Company’s Services, you can change part or all of your user information. To ensure your privacy and the security of your information, the Company will take an identity verification procedure in a reasonable manner before allowing any such change to user information. The Company does not guarantee that all changes will be applied.
